DHCR Order Not Required
LVT Number: 13655
Rent-controlled tenant complained of a rent overcharge. The DRA issued an order stating the MCR for the apartment. Landlord appealed, claiming that the DRA didn't consider the cost of a new refrigerator installed in the apartment. The DHCR ruled for landlord and increased the rent. Under the Rent Regulation Reform Act of 1993, landlord of a rent-controlled apartment is no longer required to get a DHCR order to collect a rent increase for the installation of a new appliance when landlord has gotten tenant's written consent to the increase and filed the required notice with the DHCR.
