DHCR Demolition Application Dismissed After Building Sold

Prior landlord applied to the DHCR for permission to demolish a building and terminate five rent-stabilized tenancies. The DRO ruled against prior landlord, who appealed and lost. Prior landlord then filed an Article 78 court appeal, and the DHCR agreed to take the case back for further consideration of the audits conducted during the DHCR’s processing of the application. Later the building was sold to new landlord. New landlord didn’t respond to the DHCR’s letters asking if it wanted to pursue the demolition application.

One tenant told the DHCR that new landlord was renovating vacant apartments and re-renting them. Therefore, the DHCR terminated the demolition proceeding.
