DEP Claims Landlord Didn't File Annual Report

DEP issued a violation notice to landlord for failing to file an annual test report for a backflow prevention device. Landlord claimed that he had submitted the report in March 2012. The ALJ ruled for landlord and dismissed the violation. DEP appealed and won. DEP didn't receive landlord's report until landlord submitted a copy at the hearing before the ALJ. Landlord's testimony had been vague, and he didn't say how the report was delivered to DEP. Landlord claimed that it had been submitted by his plumber. Landlord was fined $50.
