Deliveryman Assaulted in Elevator
LVT Number: 16175
Facts:A deliveryman was assaulted and robbed in an apartment building elevator. He sued landlord for negligence. The building's vestibule had an intercom system and a locked door that tenants could buzz open. A guard patrolled the building complex. The deliveryman claimed that landlord breached its duty to provide adequate security. Landlord asked the court to dismiss the case without a trial. Court:Landlord wins. There was no proof of inadequate security measures at the building. And neither landlord nor its security company owed any special duty of care to building visitors.
