Defective Light Fixture

LVT Number: 12571

Tenant complained of a reduction in services, claiming that the bathroom lights didn't work properly and required a 15 watt rapid start ballast. Landlord claimed that it wasn't responsible for the lights because they burn out over time. The DRA ruled for tenant based on an inspection showing that the light fixture was defective. Landlord appealed, claiming that it wasn't landlord's responsibility to replace a ballast in a fluorescent light fixture. The DHCR ruled against landlord.
