Debris Left by Tenant Who Moved Out

DOS issued a violation notice to landlord for having a dirty sidewalk. Landlord claimed that generally the super cleaned twice a day, at 7:00 a.m. and 1:00 p.m., and landlord did additional cleaning when necessary. Landlord claimed that a tenant moved out on the day in question at about 9:00 a.m. and left debris in front of the building. The ALJ ruled against landlord and fined her $50. Landlord appealed. ECB again ruled against landlord. Landlord is responsible for keeping the front of the building clean no matter what the cause.
