Damaged Kitchen Countertop

Yonkers tenant complained of a reduction in services. The DRA ruled for tenant, and landlord appealed. Among other things, the DRA found that tenant's kitchen countertop was damaged. Landlord claimed that the countertop was merely worn from normal use and age, but that it functioned and wasn't hazardous. The DHCR found that landlord admitted that the countertop was worn and still refused to replace it. So, the DHCR dismissed landlord's PAR.
