Court Stipulation Didn't Bar Rent Reduction

Rent-stabilized tenant complained of a reduction in services. The DRA ruled against landlord. Landlord appealed, claiming that he and tenant had signed a settlement agreement in a housing court case that resolved the service issues raised in tenant’s DHCR complaint. The DHCR ruled against landlord. Tenant claimed that there were several new leaks, after the DHCR inspected the apartment, which weren’t covered by the court stipulation. The DHCR’s inspector found water damage to the living room ceiling and wall. And landlord didn’t submit a copy of the court agreement to the DRA.
