Court Orders Landlord to Correct Immediately Hazardous Violation During Nonpayment Case

Landlord sued to evict tenant for nonpayment of rent. While the case was pending and before even filing an answer to landlord's petition, tenant filed an Order to Show Cause seeking an Order to Correct a roach infestation in the apartment. The court ruled for tenant, after a hearing, finding that the condition constituted an immediately hazardous violation and ordered landlord to correct the condition in accordance with the Housing Maintenance Code. The court also stated that, if landlord failed to comply, it would risk further findings of contempt of court and/or civil penalties.
