Landlord applied for MCI rent hikes based on elevator upgrading. The DRA ruled for landlord, and tenants appealed. Tenants claimed that modernization of the interior of the elevator cars wasn't an MCI and that the $57,000 cost of this work should be disallowed. The DHCR ruled against tenants. The elevator car modernization was directly related to and done at the same time as the elevator upgrading. So it qualified as an MCI.
