However, the DRA included in the calculation of tenant's fair market rent the 1/40th cost of certain apartment improvements. Tenant appealed, disputing the cost of some improvements. The DHCR ruled against tenant. Landlord submitted an invoice in the amount of $4,000 for kitchen and bathroom items. The invoice, along with the original work proposal and plans, sufficiently documented the work, including installation of kitchen cabinets.
