Concrete Steps Installed with Courtyard Resurfacing

Landlord applied for MCI rent hikes based on the installation of concrete steps. The DRA ruled against landlord, finding that this was ordinary repair and maintenance work. Landlord appealed and won. The work performed included not only the concrete steps but the complete resurfacing of the building's courtyard area. Since the work covered the complete resurfacing of the entire paved area within the property lines of the building, it all qualified as an MCI.
