Cleaning in Front of Building Three Times per Week Insufficient

DOS issued a violation notice to landlord for having a dirty sidewalk in front of his building. Landlord claimed that he made reasonable efforts to clean but that there was an ongoing problem with a nearby restaurant throwing trash in front of his building. Landlord said he had gone to the police department to complain. The ALJ ruled against landlord and fined him $100. Landlord appealed and lost. Landlord claimed that he cleaned in front of the building three times per week. This was insufficient. Landlord must show that efforts were made on a daily basis to keep the area in front of the building clean.
