Building Had Six Apartments and Was Subject to Rent Stabilization

Tenant complained to the DHCR of a reduction of services in his apartment. Landlord argued that tenant wasn't rent stabilized because the building contained only five apartments. The DRA then opened an "AD" proceeding to determine whether the building was subject to rent stabilization. The DRA ruled for tenant and, despite landlord's objections, found that the building was rent stabilized.
Landlord appealed and lost. Although landlord claimed it didn't receive notice, the DRA sent landlord an inspection notice and its inspector found that there were six apartments in the building, there were no commercial units in the building, there were six mailboxes, no intercom or bell buzzer system, there was a gas line with five basement meters, and an electrical line with five basement meters. All of the six apartments were occupied at the time of DHCR inspection.
