Building Had Five Units

Tenant filed a rent overcharge complaint, and the DRA ruled for tenant because landlord hadn't submitted a rental history or proof of registration. Landlord appealed, arguing that the building was exempt from rent stabilization because it's a five-family house. The DHCR ruled for landlord. The building had only five apartments on the base date, June 30, 1974, and always had five apartments after that date. So, the building wasn't subject to rent regulation.
