Appliance Surcharge Dispute

Landlord reported disputes with several tenants over whether it could impose a surcharge for tenants' washing machines and dishwashers. Landlord asked the DHCR how to resolve these disputes. In an opinion letter, the DHCR said that either landlord or tenants could start a case before the DHCR to look at these issues. Landlord could file an application for an administrative determination or tenants could file a rent overcharge or required services complaint.
