Apartment Owner-Occupied on Base Date

Tenant complained of a rent overcharge. The DRA ruled against tenant, finding no overcharge. Tenant appealed and lost. The apartment was owner-occupied on the base date, four years before the filing of tenant's complaint. So landlord was entitled to charge a first rent to tenant when she moved in, and this rent wasn't subject to challenge.
