Apartment Exempt Four Years Before Complaint Filed

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. The DHCR ruled for landlord. Four years before tenant's complaint was filed, the cooperatively owned apartment was owner-occupied and exempt from rent stabilization. Tenant moved in after that and so his first rent was the base rent. There was no rent overcharge.
