AO 262/21 Restricts Mortgage Foreclosure Actions Where Hardship Declaration Filed

On Sep. 9, 2021, the Chief Administrative Judge of the NY Court system issued AO 262/21, which supersedes some prior Administrative Orders and restricts the filing of commencement papers in mortgage foreclosure proceedings for residential properties where a mortgagor has filed a Hardship Declaration by providing generally for a stay of proceedings through Jan. 15, 2022. AO 262/21 does, however, provide for the filing of a challenge to a Hardship Declaration.
