Amended Report Filed After Deadline

The DRA suspended landlord's 1986 fuel cost adjustments. Landlord had previously gotten allowable fuel cost adjustments, but didn't serve and file the required report of the fuel cost decrease on time. Landlord appealed, arguing that former landlord had filed the form on time. The DHCR ruled for landlord. Prior landlord had filed the original fuel cost decrease report on time. It then filed an amended report several weeks after the deadline to correct a clerical error in the original. Former landlord had filed the amended form within a short time after the deadline.
