Air Conditioner Surcharge in Former Mitchell-Lama Building

Tenants in a former Mitchell-Lama building asked the DHCR if landlord could collect a monthly $12 air conditioner surcharge when apartments were converted to rent-stabilization coverage. In an opinion letter, the DHCR said yes. When a building converts to rent stabilization from Mitchell-Lama, an initial, legal regulated rent can include applicable surcharges, such as air conditioner surcharges.
