Agreement to Convert to Rent Stabilization Is Void

Landlord said his rent-controlled tenant didn't want to continue to pay MBR hikes. Landlord claimed that tenant wanted to sign a lease and become rent stabilized. Landlord asked the DHCR if this was permitted. In an opinion letter, the DHCR said no. Whether a tenant is rent controlled or rent stabilized is determined by law and regulations, not by agreement.
