10% Surcharge Allowed for Fully Furnished Sublet Apartment

Subtenant complained that she was overcharged by rent-stabilized tenant. The DRA ruled for subtenant. She appealed, claiming that the DRA shouldn't have granted tenant a 10 percent rent increase for subletting the apartment fully furnished, because the furniture was old and broken and subtenant didn't agree to rent the apartment furnished. The DHCR ruled against subtenant. The record showed that the apartment was rented to subtenant fully furnished. So tenant was entitled to the 10 percent surcharge.
